At 2115 hours on Thursday the
18 of July 2011 the police control center in Mountain City received a phone call
reporting shots fired in Bird’s Restaurant at 212 Oak Road. A patrol unit was
sent to the restaurant and arrived at 2124 hours. The restaurant owner directed them to a back
room of the restaurant, where they found a body of a male person lying on the
floor. Beside the body was a table covered with playing cards, appearing that
there had been a game of cards in progress at the time of the shooting. A check of the body revealed that he had
received three gunshot wounds to the body and ambulance personnel declared him
dead at the scene. The owner stated that the victim was playing poker in the
back room, along with the owner, the dead man, the suspect and two other men.
He identified the dead man as Goran Brown, who had been having a lucky day at
cards, winning several thousand Euros until he became involved in an argument
with one of the other players, only know by his first name, Dan. Dan accused Goran of being a cheat; Goran hit
Dan several times with his fists. Suddenly Dan pulled out a pistol and shot
Goran and then ran away. Dan was described as about 20 years old, 1.75 meters
tall, had short brown hair, dressed in blue jeans and a gray pullover shirt.
The owner of the restaurant
was interviewed, who stated that Dan fired a gun, and then ran from the
building. A further search of the room revealed two fresh bullet holes in the
card table. These two bullets were recovered from the table for forensic
examination. No empty cartridges were found at the scene; therefore it was
suspected that the weapon used was a revolver. The restaurant owner remembered
Dan talking about the old car he was driving, that it needed repairs, and that
he lost a lot of money.

Reference is made to a case
reported on 18 July 2011. An autopsy was
performed on the murder victim, identified as Goran BROWN, born on 17 January
1968 and living at 12 Main Avenue, Mountain City. The autopsy revealed that he
had been shot three times, once in the chest and three times in the arm. Death was instantaneous from the gunshot to
the chest. Three bullets were recovered from the body and placed into evidence.
The Investigative Judge authorized release of the body to the family for
funeral arrangements.

Reference is made to a case
reported on 18 July 2011. On 18 July at
2200 hours, an additional witness, Marta James, who lived next to the
restaurant in a house at 210 Oak Road, came forward and stated that at 2120
hours she heard five gunshots from the direction of the restaurant. She then saw a man running to a car parked
next to her house. She saw him throw
something away. She could hear loud
noise from the muffler as the suspect drove away toward North Road.

Reference is made to a case
reported on 18 July 2011. On 18 July
2011, at 2210 hours, officers conducted a search of the street where the Volvo
had been parked. A Smith and Wesson .38
caliber revolver, serial number SW98765, was found by the light post. There was
one live .38 round and five empty .38 cartridges in the chambers. Officers took the weapon into their custody
and notified the Investigative Judge and investigating police officers. The weapon was placed in Property and
Evidence. The Smith and Wesson .38 Special was traced to the owner, David
Green. No further information was
forthcoming, investigations are continuing.

Reference is made to a case
reported on 18 July 2011. On 19 July
2011, at 1010 hours Ballistic tests were conducted on the Smith and Wesson .38
Special. Ballistic Tests confirmed that
it was the same weapon as used in the murder.
Shortly after, the suspect came to the police station on 19 July 2011 at
1100 hours, and was interviewed. The
suspect stated that he had been gambling for several hours, and had lost money
that he was supposed to pay bills with.
He admitted that he shot the victim because he was angry and afraid
about not having the money to pay his bills.
Investigative Judge ordered his arrest and detention at the Mountain
City jail.

SUSPECT
STATEMENT NARRATIVE
One 19 July 2011at 1100 hours
a suspect wanted for the murder of Goran Brown turned himself in at the
Mountain City Police Department.
Detectives conducted an interview of the suspect, who admitted to the
killing of Mr. Brown at 2115 hours on Thursday the 18 of July 201. He stated his full name was Dan Green, and he
was born 15 March 1991. At the time of
the shooting, he was playing cards.
There were five players: the suspect, the restaurant owner named Martin
Small, the victim named Goran Brown and two other men, Frederik Popovic and
Stefan Lyon. Dan told everyone he was
playing with his rent money because he needed to try to win extra money to pay
his rent and fix his car too. He said the muffler was so loud everyone could
hear him every time he drove. Goran had
a very lucky day and won a lot of money but Dan lost 900 Euro, the amount of
his rent. Goran and Dan became involved
in an argument because Goran won so much money.
Dan became angry, and accused Goran of being a cheat. Goran hit Dan
several times with his fists. Suddenly Dan pulled out a pistol. He fired five shots and Goran fell. He said he only meant to scare Goran into
giving him back his money, but then he shot him. He said he ran out and got in his car, a
green black Volvo, which he had parked next to a house beside the restaurant. The muffler on his car made a loud noise as
he started it up and he was afraid he would be stopped by police while he was
driving, so he threw the gun outside the car window and drove away from the
restaurant, heading toward North Street.
The gun was a Smith and Wesson .38 special revolver, Serial Number
SW9876, belonging to his father, David Green.
He stated that he took the gun without his father’s knowledge.
DIALOGUE
Police Officer: Please

Suspect: My name is Dan Green; I
live with my parents in Mountain City.
Police officer: What is your age and date of birth?
Suspect: I am twenty years
old. I was born 15 March 1991.
Police Officer: What happened on 18 July 2011 at
the Bird’s Restaurant?
Suspect: We were playing a game of
cards in the back room. I was playing
poker with the owner Martin Small, Goran, Stefan Lyon and Frederik Popovic,
just the five of us. I told them I was playing with my rent money because I
wanted to win enough to get my car fixed too.
Everyone can hear me driving it because of the muffler. It is loud.
Police Officer: What happened next?
Suspect: Goran was having a very
lucky day and won a lot of money. Nine
hundred Euros of that was my money, my rent amount. I got angry and accused him of cheating and
he hit me, several times. Then I pulled a gun.
I meant to scare him into giving me my money back but I shot him.
Police Officer: What else did you do?
Suspect: After I shot Goran, I got
scared, ran out and got in my car. It
had a loud noise from the muffler like it always does when I started it. I had hoped to win enough money for repairs.
Police Officer: What did you do with the gun?
Suspect: I threw it out of the
window. I was afraid police would stop
me while I was driving and find it.
Police Officer: Where were you at when you threw it
out?
Suspect: Next to the house beside
the restaurant, where I parked my car.
